Eagle Eye Property Maintenance and Management - General Terms and Conditions

1. Introduction Welcome to Eagle Eye Property Maintenance and Management, a trading name of Eagle Eye Group Ltd. These Terms and Conditions govern your engagement of our general property maintenance and management services. By instructing us to carry out work, you agree to be bound by these terms.

"Eagle Eye Property Maintenance and Management" (referred to as "Eagle Eye PM", "we", "us", or "our") is a trading name of Eagle Eye Group Ltd, a company registered in England and Wales with Company Number 16390020 and having its registered office at 105 Walton Drive, High Wycombe, HP13 6UA, Buckinghamshire, United Kingdom.

"Client" refers to any individual or entity that engages our services. "Property" refers to the location where the services are carried out under agreement with Eagle Eye PM. "Services" refers to any property maintenance or management tasks Eagle Eye PM provides, as outlined in our quotations or agreements.

2. Scope of Services Eagle Eye PM provides a range of property maintenance and management services, including but not limited to:

We will perform services with reasonable care and skill. Any estimated completion times are given as guidelines only and do not form part of a contractual guarantee.

Please note: For specific recurring maintenance packages, such as our Eagle Eye Guardian Plans, additional and specific terms and conditions apply. Where those specific terms are inconsistent with these general terms, the terms of the Eagle Eye Guardian Plans will take precedence for services provided under those plans.

3. Quotations and Payment 3.1. Quotes provided by Eagle Eye PM are valid for 10 days from the date of issue. 3.2. Payment for Services is due upon completion, unless otherwise agreed in writing (e.g., for ongoing contracts or specific payment schedules for larger projects). 3.3. We accept Bank Transfers (BACS) and Direct Debit. 3.4. Late payments may incur a late fee of 4 percent per month from the due date. 3.5. If extra work is needed beyond the scope of the original agreed quotation, the Client will be notified, and an additional charge will be applied with the Client's prior agreement.

4. Client Responsibilities 4.1. Clients must provide safe, clear, and unobstructed access to the Property for our operatives to perform the Services. 4.2. Clients must provide accurate and complete information regarding the Property and the required Services. 4.3. Clients are responsible for ensuring that all necessary permissions, consents, and licenses are obtained prior to the commencement of any work by Eagle Eye PM.

5. Liability and Insurance 5.1. Eagle Eye PM holds comprehensive Public Liability Insurance. Details are available upon request. 5.2. We are not liable for any indirect, consequential, or economic losses, including but not limited to loss of profit, loss of business, or loss of opportunity. 5.3. The total liability of Eagle Eye PM to the Client arising out of or in connection with the provision of Services shall be limited to the total cost of the specific Services provided. 5.4. Eagle Eye PM is not responsible for any damage or issues caused by pre-existing faults, latent defects, or conditions within the Property that were not apparent upon initial inspection and not directly caused by our work. 5.5. All workmanship carried out by Eagle Eye PM is guaranteed for 12 months from the date of completion. This guarantee covers defects arising directly from our workmanship. It does not cover defects arising from normal wear and tear, misuse, accidental damage, or work carried out by third parties.

6. Use of Subcontractors 6.1. To ensure efficient and expert service, particularly for specialised tasks, Eagle Eye PM may engage carefully selected and qualified subcontractors. 6.2. All subcontractors engaged by Eagle Eye PM will be required to hold their own adequate Public Liability Insurance. 6.3. Where a subcontractor is engaged for specific works, their primary liability for any direct damage or injury caused by their negligence will typically lie with their own Public Liability Insurance. Eagle Eye PM maintains its own Public Liability Insurance to cover its overall responsibilities and oversight. 6.4. By engaging our Services, the Client acknowledges and consents to the use of such qualified subcontractors by Eagle Eye PM where deemed necessary.

7. Gas and Electrical Safety 7.1. Any gas and electrical work carried out by Eagle Eye PM will be performed by appropriately qualified and certified tradespeople in accordance with relevant safety regulations. 7.2. Where applicable, Eagle Eye PM will provide the Client with the relevant safety certificates upon the completion of any gas or electrical work.

8. Termination of Services 8.1. Either party may terminate the provision of Services by providing the other party with reasonable written notice, the length of which will depend on the scope and duration of the agreed services. 8.2. Eagle Eye PM may terminate the provision of Services immediately upon written notice to the Client if the Client fails to make payment when due or commits a material breach of these Terms and Conditions.

9. Data Protection Any personal data collected by Eagle Eye PM from the Client will be processed in accordance with UK data protection laws. Our Privacy Policy, available at https://www.eagleeyepm.co.uk/privacy-policy, provides detailed information about how we collect, use, and protect your personal data. By engaging our Services, you consent to the processing of your personal data in accordance with our Privacy Policy. We will not share any Client personal data with third parties without the Client's explicit prior consent, except where legally required.

10. Dispute Resolution Any disputes or disagreements arising between the Client and Eagle Eye PM shall initially be attempted to be resolved amicably through good faith negotiation. If a resolution cannot be reached, any such dispute shall be governed by and construed in accordance with the laws of England and Wales, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.

11. General Provisions 11.1. These Terms and Conditions constitute the entire agreement between the Client and Eagle Eye PM for general services and supersede all prior discussions, agreements, or understandings, whether oral or written. 11.2. Eagle Eye PM reserves the right to update or amend these Terms and Conditions at any time. We will make reasonable efforts to notify Clients of any significant changes, for example, by posting the updated terms on our website. Continued engagement of our Services following such notification constitutes acceptance of the revised Terms and Conditions. 11.3. If any provision of these Terms and Conditions is found by any court or competent authority to be invalid, illegal, or unenforceable, that provision shall be deemed to be severed, and the remaining provisions shall continue in full force and effect.
